THE VINE HOUSE (UK) LTD CONDITIONS OF SALE 2024/2025 SEASON
The terms below apply to all orders placed with Vine Importers UK Limited trading as The Vine House (UK) Ltd. The Vine House (UK) Ltd is referred to in these terms as “We”, “Our” and “Us”.
These terms refer to the signee or purchaser as “The Customer” and “You”.
Any payment, order or potential order is referred to in these terms as “Your Order”.
“Protected Varieties” refers to vines protected by Plant Breeders Rights. These include but are not limited to: Acolon, Bianca, Divico, Johanniter, Orion, Phoenix, Regent, Rondo, Solaris, Muscat Bleu and Polo Muscat. See (8) for more information.
“DEFRA” in these terms refers to the Department for Environment, Food & Rural Affairs.
By placing an order with The Vine House (UK) Ltd you accept these terms and conditions of sale. We advise all purchasers to thoroughly read through these and contact us for any clarification before placing an order.

1 PLANT PASSPORTS
All our imported root stock and grafted plants are grown and inspected under the European Plant Passport scheme conditions. They receive a further inspection prior to travel to the UK by local plant health inspectors who issue a Phyto-Sanitary certificate. On arrival in the UK, the vines are met and inspected by DEFRA inspectors who also check plant quality and confirm the certifications and Phyto-Sanitary certificates are genuine and that plants are free from all diseases including, but not limited to Xylella, Trunk Disease, Fan Leaf, Leaf Roll, and Marble Leaf Disease. Vines will be supplied with a UK Plant Passport, giving full traceability back to the grower, variety, clone and rootstock. Current DEFRA legislation requires you to retain these passports for future inspections. Customers are required to verify all documentation on receipt and report any issues immediately. We accept no liability for loss and/or misplacement of these passports following delivery. 1.1 We accept no liability for any diseases found after this inspection.
2.1 DELIVERY
We make every effort to arrange delivery on a date to suit the customer. We work closely with our carriers but we are not responsible for delivery failure by the carrier or if the carrier are unable to deliver to the customers designated site.
2.2 All deliveries are scheduled to be made before commencement of the second week in May. If You require a dispatch date after 12th May 2025, there will be a cold storage charge payable of £2.50 per day.
3. VINES ON ARRIVAL
Please inspect Your vines on arrival. We always aim to supply high quality plants, which are cold stored until dispatch. You must let us know about any problems that may have arisen during transport as soon as possible by providing a thorough description of the problem and images to thevinehouseuk@gmail.com.
3.1 Any complaints about the condition of vines on arrival should be made as soon as possible and in any case within 3 days, in writing. These timeframes are from the date of delivery. The vines should then be repacked thoroughly and returned within 7 days.
3.2 We will not be liable for any complaints arising from the condition of the vines made 4 days or later from the date of delivery.
4. PAYMENT TERMS
Orders for some special clones and French rootstocks are to be paid for in full at the time of ordering. Contact us for clarification on which varieties this refers to beforehand. For special clones and French rootstocks, orders will not be processed or delivered without full payment.
4.1 In all cases accounts are to be settled no later than 1st February 2025; or before the vines are dispatched if purchased after that date. Late payments will incur a fee of 5% per month on the outstanding amount.
4.2 We use Iwoca Pay to allow customers to spread the cost.As they are a separate company, their credit terms apply. Visit https://iwocaPay.me/vine-importers-uk-limited for more information. All goods remain the property of The Vine House (UK) Ltd until paid for in full.
5. REFUNDS
The Customer is liable for the cost of the full order amount if cancelling after 1st January. All goods remain the property of The Vine House (UK) Ltd until paid for in full. Our prices are correct at the time of quoting, though any additional unknown import trade tariffs are not quoted in any of our prices.
5.1 The Customer is liable for any additional customs or tariffs added to your order. Please be aware that deposits paid may be subject to adverse currency fluctuations and refunds may incur additional deductions as a result.
5.2 In cases where The Vine House (UK) Ltd has to cancel the order due to a Force Majeure or other circumstances outside our control, full refunds will be processed. Refunds may be adjusted for currency fluctuations, which will be clearly explained and documented.
6. ADVICE
We are happy to offer advice about varieties, clones and rootstocks. This advice is for general guidance only. The customer is responsible for the final selections, considering factors such as site, soil, training methods, and local climate conditions. 7. LIABILITY
Complaints about plant health, vines not true to type, or complaints of any other nature must be reported in the first growing season. Our liability in the event of any complaint will be limited to providing replacements at the start of the second season, or at our discretion a partial refund of the original cost of the vines. All other claims, including consequential loss, are specifically excluded.
7.1 The Vine House UK (Ltd) are not liable for any loss or damage due to vines planted in unsuitable environments or for any loss or damage due to adverse weather conditions such as extreme rainfall, flash floods or other scenarios which result in vines failing.
8. PROTECTED VARIETIES
Please note that some modern varieties are protected by PBR (Plant Breeders Rights) legislation, and that you must not under any circumstances propagate them or allow anyone else to do so. Protected varieties including all PIWI Hybrid varieties for example Acolon, Bianca, Divico, Johanniter, Orion, Phoenix, Regent, Rondo, Solaris, Muscat Bleu and Polo Muscat. This list is not exhaustive, and We recommend conducting your own research into this we make every effort to make you aware of a protected variety before you order with the latest information we have.
8.1 The Vine House (UK) Ltd are not liable for any loss caused by court action or infringement proceedings due to PBR propagation by You or a party associated with You.
